Update 1-21-22

If you’ve driven down Canal Street recently, you can see some construction going on at 1103 S. Canal Street. We’re excited to see development for the new HTeaO, which specializes in ice tea drinks. This Amarillo-based company is known for having 26 different flavors of tea, and cup sizes that range all the way up to 51 ounces. HTeaO will be a very welcome business in Carlsbad, and we also know that they will do very well here.

New Mexico Senator Gay Kernan has introduced Senate Bill 137, which would amend the tax code to restore revenue loss for municipalities generated by what’s called destination sourcing. House Bill 6, which passed in 2019, was originally implemented to capture revenue from online sales.

However, one consequence of the change was that local governments lost the local distribution they would receive from gross receipts tax collected by the state that were not sold in the same municipality as where a business was located. Senate Bill 137 seeks to remedy a portion of this issue to make sure these funds stay local.

“Not properly considering the impact to our local governments has triggered an attempt to find a temporary solution until data can prove the significant loss of revenue to our local governments,” Senator Kernan said in a press release. “This issue is a monumental revenue loss for many cities, large and small, that rely on this distribution. In my part of the state, our cities produce energy and provide related services generating significant revenue for the rest of our state and nation. The lost revenue from the state means our local governments must cut back programs our people depend on. This bill is a simple fix that will help our local governments continue to maintain staff and provide services until a permanent resolution can be considered and adopted.”

Senator Kernan and our local delegates are also looking into other long-term solutions to this issue, and we appreciate their dedication and commitment.
